Did you come back home and found a for sale sign on you the property you are renting? What
happens next? Is a landlord permitted to ask you to leave? The short answer is no, however, a landlord
is allowed to sell a property anytime, unconditionally. A landlord doesn’t have to tell you, the tenant,
but obviously you would know, because unless it’s a private deal, there would be a sign on the lawn and
there will be people coming through for showings.
The sale of a property does not necessarily end the tenancy. Unless the buyer or their
immediate family member plans to move in, they are required to let the tenant stay as long as they
want.
Once the Buyer indicates that they are moving in, the landlord must provide the tenant with a
notice of no less than 60 days if it’s a month to month tenancy. If the tenant is in a yearlong agreement
and the year has not finished yet, the tenant can stay until the end of that term.
If earlier closing is required the landlord can then agree with the tenant to a settlement and try
to come up with favourable terms of compensation for moving. Or, the case can proceed to a hearing,
where the tenant would need to explain why they think the notice was not served in good faith.
